Terms and Conditions

Last updated

Please read these Terms carefully. They include rules against scraping and copying the Service's assets (Section 7), our refund policy (Section 10) and limits on our liability (Section 15).

1. Agreeing to these Terms

These Terms and Conditions ("Terms") are an agreement between you and elianrichard ("we", "us"), who makes and runs EZ Mockup at ezmockup.app, including the editor, the website and any related features, files and services (together, the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

If you use the Service for a company or other organization, you accept these Terms on its behalf and confirm that you're authorized to do so.

2. Who can use the Service

You must be at least 13 years old, or the minimum age for using online services in your country if that's higher. To create an account or buy Pro, you must be old enough to enter a binding contract where you live, or have a parent's or guardian's permission. You can't use the Service if the law, including sanctions law, prohibits you from doing so.

3. The Service

EZ Mockup is a browser-based tool for placing pictures in device frames and on backgrounds and exporting the result as images, videos or ZIP files. Core features are free and need no account. Some features ("Pro") need an account and a purchase.

Your pictures are processed in your browser and are never uploaded to us. The Service doesn't save your work: it's lost when you close or reload the tab, so export anything you want to keep.

Pro also includes an MCP server that AI agents you connect, such as Claude Code, Codex or Cursor, can use to render mockups for you (see how it works). Unlike the editor, it renders on our servers, so the screenshots your agent sends it are uploaded to us, as our Privacy Policy describes.

We may add, change or remove features, or suspend or discontinue the Service, at any time. Exports depend on your browser and device, and some features, such as video export, may not work in every browser. If a change takes away Pro features you've already paid for, Section 9 applies.

4. Accounts

You sign in with your Google account. You're responsible for keeping it secure and for everything done through your EZ Mockup account.

  • An account is for one person. You can use it on any of your own devices, but you may not share, sell, rent, lend or transfer your account or your Pro access, or let anyone else use them.
  • Don't create accounts by automated means, or create more than one account to get around limits, refunds or a suspension.
  • Tell us right away if you think someone else is using your account.
  • MCP access tokens are personal, like passwords: keep them secret, don't share them, and revoke any you think has leaked. You're responsible for what your agents do with them, and for having the rights to the screenshots they upload. The MCP server has fair-use limits, shown in its account tool, which we may change. We may revoke tokens or limit use to stop abuse.

5. Your content and exports

  • You own your content. You keep all rights in the pictures you add and the mockups you export. We claim no ownership of them and, because they never leave your device, we get no license to them.
  • You're responsible for it. You must have the rights you need for everything you put into the Service, and your use of exports must respect the law and other people's rights.
  • What you can do with exports. You may use the images, videos and ZIP files you export from the Service, including the device frames, backgrounds and effects as they appear in them, for any lawful personal or commercial purpose: app store listings, websites, marketing, social media, presentations and client work. This covers the exported mockups only. It doesn't let you extract, separate or redistribute the underlying assets on their own (see Section 7).
  • Trademarks in exports. Device names and designs belong to their manufacturers. You're responsible for following their brand guidelines and for not implying that a manufacturer endorses you.
  • No deception. Don't use the Service to create images that are fraudulent or misleading when presented as genuine, such as fake payment confirmations, receipts, bank statements, chats, reviews or endorsements, or to impersonate anyone.

6. Our content and your license

Apart from your content, the Service and everything in it belong to us or our licensors and are protected by copyright, trademark, database and other laws. That includes the software and source code, the interface and its design, the device frame artwork, the 3D models as adapted for the Service, backgrounds, presets, text, graphics, and the EZ Mockup name and logo (the "Service Materials").

Subject to these Terms, we give you a limited, personal, revocable, non-exclusive and non-transferable license to access and use the Service through a standard web browser and its normal interface, to create mockups for the purposes in Section 5. We reserve all rights we don't expressly grant. Any use beyond this license, including anything Section 7 prohibits, is unauthorized and infringes our rights or our licensors' rights.

Open-licensed materials. Some materials in the Service are provided by third parties under open licenses, such as the 3D device models credited on our home page under Creative Commons Attribution 4.0. Those materials are governed by their own licenses, and nothing in these Terms restricts any right those licenses give you. Our own contributions, such as the Service's code and our adaptations and compilations, remain covered by these Terms.

7. Acceptable use, scraping and asset extraction

You must not, and must not help, encourage or allow anyone else to:

  1. Scrape or crawl: access, collect, copy or monitor the Service, or any content, assets or data on it, by automated means, including bots, spiders, crawlers, scrapers, scripts, headless browsers, browser extensions, AI agents or offline readers, or by manual bulk copying. Using the MCP server as documented, to render your own mockups, is allowed; using it to collect Service Materials in bulk is not.
  2. Extract assets: download, copy, save or extract device frame images, 3D models, textures, backgrounds, presets, source code or other Service Materials, whether from our servers, the page source, network traffic, your browser's cache or developer tools, other than as part of a mockup you export with the Service's own export features.
  3. Redistribute assets: sell, license, share, publish, upload or otherwise make Service Materials available on their own or as part of another product, such as a device frame pack, mockup template, 3D asset library, design kit, plugin, app or dataset, whether paid or free and whether or not modified.
  4. Copy the Service: copy, mirror, frame, clone or republish any part of the Service, or make derivative works of the Service or Service Materials, other than the mockups you export under Section 5.
  5. Build competing products or AI models: use the Service or Service Materials, or exports made to reproduce them, to build or improve a competing product or service, or to create, train, fine-tune or evaluate any AI or machine-learning model or dataset, except as the search engine exception below allows.
  6. Reverse engineer: decompile, disassemble or reverse engineer the Service, or try to derive its source code, except where the law expressly allows it despite this restriction.
  7. Bypass Pro or our protections: circumvent, disable or interfere with Pro features, export limits, credit counts, preview watermarks, rate limits, bot detection, authentication or any other access control or technical measure, or obtain the output of Pro features without paying, for example by recording the watermarked preview and removing the watermark.
  8. Abuse purchases: pay with a payment method you're not authorized to use, make fraudulent chargebacks or refund requests, exploit bugs or pricing errors instead of reporting them, or resell, share or transfer Pro access.
  9. Use unofficial access: call our APIs or endpoints directly or with any tool other than the Service's own interface, or access any part of the Service you're not authorized to access.
  10. Overload or attack: send excessive requests, disrupt the Service or its servers or networks, introduce malware, or probe, scan or test the Service for vulnerabilities without our written permission. If you find a security problem, email us instead.
  11. Harvest personal data: collect or store information about other users.
  12. Remove notices: remove, obscure or change copyright, license, attribution or other notices in the Service, including the credits for third-party 3D models.
  13. Misuse our brand: use our name or logo, or suggest that we endorse or are affiliated with you, without our written permission.
  14. Break the law: use the Service in a way that is unlawful, infringes anyone's rights, or is fraudulent, deceptive, defamatory, harassing or harmful.

Search engine exception

Search engines and AI assistants that identify themselves honestly and follow our robots.txt may crawl our public web pages to index them and to use their text in search results, AI answers and AI models. This exception covers the text of public pages only. It doesn't allow downloading, storing, collecting or redistributing device frames, 3D models, images, code or other Service Materials, and we may withdraw it from any crawler at any time.

Neither our robots.txt nor the fact that a file can be reached over the internet gives anyone permission to do what these Terms prohibit.

8. Enforcement

We may monitor use of the Service and investigate suspected breaches of these Terms. If we believe you've breached them, we may, without notice, rate-limit, challenge or block your access, including by IP address or network; suspend or close your account and end your Pro access without a refund; and take legal action, including for breach of contract, copyright or trademark infringement and unauthorized computer access, seeking damages, injunctions and our legal costs where the law allows. We may also report illegal activity to the authorities and cooperate with them.

9. Pro passes and export packs

  • What you're buying. A Pro pass gives you Pro features for the period shown at purchase (for example, 7 or 30 days), starting when you buy it. If you buy a pass while another is active, its time is added to the end of the current one. An export pack gives you the number of Pro exports shown at purchase. One export is one export job, such as a video, a GIF, a Pro still image or a ZIP, and a credit is used only once the file has finished rendering. Export credits don't expire.
  • One-time payments. Prices are shown before you pay. Passes and packs are one-time purchases, with no subscription and no automatic renewal.
  • Polar is the seller. Purchases are sold and processed by Polar (polar.sh), our merchant of record, and Polar's checkout terms apply to your payment. Polar handles payment, invoices, sales tax and VAT, so the price you pay may include or add tax depending on where you are.
  • A license, not property. Pro access is a personal license to use features of the Service. It has no cash value, can't be transferred or resold, and ends when the pass expires, the credits are used, or your account is closed.
  • Changes. We may change prices and what Pro includes. Price changes don't affect purchases you've already made. If we materially reduce Pro features during a pass you've paid for, or discontinue the Service, we'll refund the unused part of your pass and any unused export credits.
  • Delivery. Pro is added to your account as soon as your payment is confirmed. If it doesn't appear, use "Restore purchases" in the account menu or email us.
  • EEA and UK consumers. By buying, you ask for Pro to start right away and acknowledge that you lose your 14-day right of withdrawal once a pass starts or once you use an export credit. Our refund policy in Section 10 still applies.

10. Refunds

Something not working? Email elianrichards@gmail.com within 7 days and we'll make it right.

  • Export packs are refunded within 14 days of purchase if none of the pack's exports have been used.
  • Pro passes are refunded within 7 days of purchase if Pro didn't work for you, for example if your browser couldn't export a video.
  • Anything else is decided case by case.

Refunds go back to your original payment method through Polar, and the matching Pro time or export credits are removed from your account. Polar may also issue refunds under its own policies. Please contact us before disputing a charge with your bank; we can usually sort it out faster. Nothing in this section limits your rights under consumer law.

The full policy, including how to ask for a refund, is in our Refund Policy.

11. Ending your use

You can stop using the Service at any time and delete your account from the account menu. We may suspend or end your access as described in Section 8, or where the law requires it. If we close your account or discontinue the Service for any reason other than your breach of these Terms, we'll refund the unused part of any active pass and any unused export credits. Sections 5 to 8 and 12 to 19 survive the end of these Terms.

12. Third-party services and trademarks

The Service relies on and links to third-party services, such as Google for sign-in, Polar for payments, Ko-fi and GitHub. Their own terms and policies apply when you use them, and we're not responsible for them.

iPhone, iPad, MacBook, iMac, Apple Watch, Pixel, Galaxy and other device names and designs are trademarks of their owners. EZ Mockup isn't affiliated with or endorsed by Apple, Google, Samsung, Microsoft, Motorola, Dell, Sony or any other device maker.

If you believe something in the Service infringes your copyright or other rights, including if you made a third-party asset we use and believe we're not meeting its license, email elianrichards@gmail.com with: the work concerned; where it appears in the Service; your contact details; a statement that you believe in good faith the use isn't authorized; and a statement, under penalty of perjury, that your notice is accurate and that you own the rights or are authorized to act for the owner. We'll review it promptly and remove or fix the material where appropriate.

14. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the Service will be uninterrupted, error-free or secure, that it will work in every browser or on every device, or that exports will meet your needs. You're responsible for saving your work and keeping copies of your exports.

15. Limitation of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising from or related to the Service or these Terms, even if we were told they were possible. Our total liability for all claims relating to the Service or these Terms is limited to the greater of what you paid for Pro in the 12 months before the claim arose and USD 50.

Nothing in these Terms excludes or limits liability that the law doesn't allow us to exclude or limit, such as liability for death or personal injury caused by negligence or for fraud, or your statutory rights as a consumer.

16. Indemnity

To the extent the law allows, you'll defend, indemnify and hold us harmless from any claims, losses, damages and costs, including reasonable legal fees, arising from your content, your use of exports, your breach of these Terms (including Section 7), or your violation of any law or anyone else's rights.

17. Governing law and disputes

These Terms, and any dispute arising from them or the Service, are governed by the laws of the country where we're established, without regard to conflict-of-laws rules, and the courts of that country have jurisdiction. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings in its courts. Before starting proceedings, please email us so we can try to resolve the issue informally within 30 days. We may seek urgent injunctive relief, for example to stop scraping or infringement, in any court with jurisdiction.

18. Changes to these Terms

We may update these Terms. We'll change the date at the top and, for significant changes, give notice on the site or by email to signed-in users before they take effect. Changes don't apply retroactively: the refund terms in force when you bought Pro still apply to that purchase. If you keep using the Service after changes take effect, you accept them; if you don't agree, stop using the Service and delete your account.

19. General

  • Entire agreement: these Terms, our Privacy Policy and, for purchases, Polar's checkout terms are the whole agreement between you and us about the Service.
  • Severability: if any part of these Terms is found unenforceable, it's enforced as far as possible and the rest stays in effect.
  • No waiver: not enforcing a part of these Terms doesn't waive our right to enforce it later.
  • Assignment: you may not transfer your rights under these Terms. We may transfer ours, for example as part of a sale of the Service.
  • Events beyond our control: we're not responsible for delays or failures caused by events beyond our reasonable control.
  • Language: these Terms are written in English. Any translation is for convenience only.
